Terms of Service

The agreement that governs use of the Payixay platform.

Last updated: 10 July 2026 · These terms are entered into with Emcenton Technology Limited, Blueviolets Plaza, Kindaruma Road, Kilimani, Nairobi, Kenya (“Emcenton”, “we”, “us”), which operates the Payixay payment technology platform (“Payixay”, the “Platform”).

1. Who we are and what these terms cover

These Terms of Service govern your access to and use of the Platform, including the merchant dashboard, APIs, hosted checkout and related services. By creating a merchant account or using the Platform you agree to these terms on behalf of the business you represent.

Payixay is a payment technology platform. Card acquiring, funds custody and fiat settlement services are provided by banking, acquiring and technology partners, including Akurateco, under their own regulatory permissions. Your merchant agreement identifies the partners relevant to your configuration.

2. Eligibility and onboarding

Use of the Platform requires a completed application and successful KYC/KYB verification, including business registration documents, director identification and beneficial ownership information. We may decline, suspend or terminate accounts that fail verification, operate in restricted categories, or present unacceptable compliance risk. Services are not available in jurisdictions subject to OFAC sanctions, United Nations sanctions, or other applicable regulatory restrictions.

3. Your obligations

  • Provide accurate, current information during onboarding and keep it updated.
  • Use the Platform only for lawful transactions for the business and website(s) approved during onboarding.
  • Comply with card network rules, applicable law, and the acceptable use requirements in your merchant agreement.
  • Protect your API credentials and dashboard access; transactions initiated with your credentials are your responsibility until you notify us of a compromise.
  • Not process transactions on behalf of undisclosed third parties (no aggregation without approval).

4. Fees and settlement

Processing fees, currency conversion fees, chargeback fees and settlement schedules are set out in your merchant agreement. Settlement may be made in USD or, where agreed and permitted, in USDT. We may deduct fees, refunds, chargebacks and reserves from settlement amounts. Reserves, where applied, are stated in your merchant agreement.

5. Refunds, chargebacks and disputes

You are responsible for refunds to your customers and for chargebacks raised against your transactions, including associated network fees. Our Refund Policy describes how refunds of our own service fees are handled.

6. Stablecoin settlement

If you elect USDT settlement, you acknowledge that USDT is issued by a third party, that its value depends on the issuer maintaining its dollar peg, and that transfers on blockchain networks are irreversible. USDT settlement is offered subject to compliance review and applicable law in your jurisdiction.

7. Security and data

Card transactions are processed on gateway infrastructure provided by Akurateco, whose technology is PCI DSS Level 1 certified. Our handling of personal data is described in the Privacy Policy.

8. Availability

We target the service levels described in our Service Level Agreement. The Platform depends on card networks, banking partners and telecommunications infrastructure that we do not control, and we do not guarantee uninterrupted availability.

9. Suspension and termination

We may suspend or terminate access where required by law or partners, for material breach of these terms, for elevated fraud or chargeback levels, or for compliance risk. You may close your account at any time; accrued fees and pending chargebacks survive closure.

10. Liability

To the maximum extent permitted by law, our aggregate liability for claims arising out of the Platform in any 12-month period is limited to the fees you paid to us in that period. We are not liable for indirect or consequential loss, or for losses caused by card networks, banking partners, blockchain networks or events beyond our reasonable control.

11. Governing law

These terms are governed by the laws of Kenya, and disputes are subject to the exclusive jurisdiction of the courts of Nairobi.
